You are wholly responsible for any unauthorized access to your account that occurs as a result of a lapse of security on your part, and you must notify Yivera of any such access or suspected access immediately.

You may purchase digital downloads from the catalogue of tracks that Yivera holds on the Site ("Transaction(s)"). You warrant that if you enter into a Transaction, you shall be able to make full and immediate payment for the requested products or services. There are distance selling regulations that apply to downloads of music from this Site but the supply of digital downloads is the supply of service and although you have a cooling off period of 7 days after you have ordered the Track as soon as you have requested that Yivera provide the Service (i.e. commence the download) then you do not have any further rights to cancel.

You warrant that if you enter into a Transaction, you shall be able to make full and immediate payment for the requested products or services.

You agree that your use of the Site is on an 'as available' basis. Except as otherwise expressly required by applicable law, Yivera makes no representations, warranties, conditions or other terms (whether express or implied) in relation to the provision of the Site, including without limitation as to completeness, accuracy and currency or any content on the Site, or as to satisfactory quality, or fitness for particular purpose.

To the maximum extent permitted by applicable law, Yivera excludes all liability (whether arising in contract, tort, breach of statutory duty or otherwise) which Yivera may otherwise have to you as a result of any error or inaccuracies in any content, the unavailability of the Site for whatsoever reason, and any representation or statement made on the Site.

Notwithstanding any other provision of these terms and conditions, Yivera does not exclude or limit our liability for any other statutory rights which are not capable of being excluded.

This document and all other agreements and aspects of the Site are governed by the laws of the State of Delaware. By using this Site and/or any of the services provided by Yivera you agree that all business conducted between you and Yivera shall be subject to the laws of the State of Delaware, and any dispute that may arise between you and Yivera concerning any element of Yivera's business shall be subject to the exclusive jurisdiction of the courts of Delaware.

Yivera reserves the right to suspend or terminate your account or your access to the Site at any point.

Modification of the Terms. Distributor reserves the right, at our discretion, to change, modify, add, or remove portions of these Terms, at any time for any reason, and we may notify you of such changes through any of a variety of means, including a change to the "Last Updated" date set section updated (where applicable) and other reasonable means to be determined in our discretion. All changes shall be effective immediately. In the event of a material change that may directly affect your account, we will use reasonable efforts to notify you via the most recent email address that you have provided to us in conjunction with your account.

Please check these Terms periodically for changes. Your continued use of the Distributor Sites one month after the posting of changes constitutes your binding acceptance of such changes. If you decide to discontinue due to any changes made to our terms and conditions, including our privacy policy and other policies on the site, you shall notify us in writing via support@yivera.com
